General terms and conditions of sale

GENERAL TERMS AND CONDITIONS OF SALE

1 – PRICES

1.1

The prices of our products are indicated in shekels, including all taxes, but excluding handling and shipping costs, unless it is expressly stated that shipping costs are included.

For orders delivered to a country other than Israel, you are considered the importer of the product or products concerned. You do not pay taxes, and the base prices of the items will be those indicated on the website.

Customs duties, other local taxes, import duties or state taxes may be payable. Such duties and amounts do not fall within the responsibility of Sofrout.com. They shall be borne by you and remain your sole responsibility, both with regard to declarations and payments to the competent authorities and/or organisations in your country.

We recommend that you obtain information concerning these matters from your local authorities.

1.2

All orders, regardless of their origin, are invoiced in shekels.

1.4

Sofrout.com reserves the right to change its prices at any time. However, products shall be invoiced on the basis of the prices in force at the time the order is registered, subject to availability on that date.

1.5 – Retention of title clause

The products shall remain the property of Sofrout.com until Sofrout.com has received payment of the price in full.

2 – ORDERS

The contractual information is presented in French and shall be confirmed, including all contractual information, no later than at the time of delivery.

Sofrout.com reserves the right to cancel or refuse any order placed by a customer with whom there is an existing dispute relating to the payment of a previous order.

3 – CONFIRMATION

You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order.

The confirmation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale.

Unless proven otherwise, the data recorded by Sofrout.com shall constitute evidence of all transactions carried out between Sofrout.com and its customers.

4 – AVAILABILITY

Our product and price offers are valid for as long as they remain visible on the website and while stocks last.

For products that are not stored in our workshop, our offers are subject to availability from our suppliers. In this context, information concerning product availability is provided when you place your order.

Since this information is supplied directly by our suppliers, errors or changes may exceptionally occur.

Should a product become unavailable after you have placed your order, we shall inform you by email or by post. This information shall be provided within a maximum period of four working days.

You shall then have the option of requesting the cancellation of your order or the exchange of the unavailable product or products.

Should the unavailability continue beyond the period previously announced, a new email or letter shall be sent to you before the expiry of the previously announced period. As before, you shall have the option of requesting the cancellation of your order or the exchange of the unavailable product or products.

5 – DELIVERY

5.1 – General provisions

Products purchased from Sofrout.com are delivered to the delivery address provided by you during the ordering process.

The delivery times indicated are average times and include both processing and delivery.

Where items are available for delivery on different dates, the delivery time shall be based on the longest delivery time. Sofrout.com nevertheless reserves the right to divide the delivery into several shipments.

Handling and shipping costs shall only be charged for one shipment.

Sofrout.com shall not be held liable for the consequences of a delay in delivery. In the event of a delay, an email shall be sent to you.

In the event of payment by bank card or private-label payment card, the times indicated are average processing and delivery times.

In the event of payment by bank transfer, the order shall only be processed once the transfer has been received. Consequently, the applicable delivery times shall begin on the date the bank transfer is received and may therefore differ from those indicated on the date the order was placed.

5.2 – Delivery problems

You must notify both the carrier and Sofrout.com of any reservations concerning the delivered product, such as a damaged or previously opened parcel, within three days following receipt of the product.

5.3 – Product conformity

We undertake to refund or exchange products that do not correspond to your order.

In such a case, please provide us with a detailed written description of the issue and return the product or products concerned.

Sofrout.com shall exchange or refund the product or products.

The request must be made within seven working days following delivery. Any complaint submitted after this period shall not be accepted.

Products must be returned in the condition in which they were received, together with all delivered items, including accessories, packaging and instructions.

Shipping costs shall be refunded on the basis of the amount originally charged.

In all circumstances, you shall benefit from the provisions of the statutory warranty, particularly those relating to hidden defects.

The provisions of this section do not prevent you from exercising the right of withdrawal provided for in Article 8.

6 – PAYMENT

Payment for your purchases may be made by bank card, including Visa, MasterCard, Switch, American Express or other Carte Bleue cards, by bank transfer or through PayPal.

7 – REFUNDS

Refunds for products in the circumstances referred to in Articles 5 and 8 shall be made within a period not exceeding one month after we receive the returned products.

The refund shall be made using the payment method used by the customer at the time of purchase, in the name of the customer who placed the order and using the billing details provided.

No cash-on-delivery shipment shall be accepted, regardless of the reason.

Customisable or personalised products shall under no circumstances be refunded.

8 – WITHDRAWAL PERIOD

You have a period of seven days from receipt of the product to return any product that does not suit you.

The product must be returned in its original packaging, complete with all accessories and instructions, in good condition and accompanied by a copy of the invoice.

In the event of a return and a refund request, the following conditions shall apply:

Parcel returned without having been opened, including an unopened, undelivered or refused parcel: the parcel shall be refunded, with return shipping costs borne by the customer.

Parcel returned at the customer’s own request: the product shall be refunded, with return shipping costs borne by the customer.

Parcel returned due to the responsibility of the company, including non-conformity or a clearly excessive delay compared with the delivery time announced: the product shall be refunded and the return shipping costs shall be borne by Sofrout.com.

Items returned incomplete, damaged, deteriorated or soiled by the customer shall not be accepted.

Personalised items shall under no circumstances be refunded or exchanged.

9 – RIGHT OF WITHDRAWAL

In accordance with European and national regulations, the Customer has a right of withdrawal of seven working days for any distance contract.

This period begins on the date on which the Customer places the order on the Website.

A Customer wishing to withdraw must send, before the expiry of this seven-day period, either an email to Sofrout.com customer service or a registered letter addressed to the customer service department, whose contact details appear in Article 10 of these General Terms and Conditions. The postmark shall serve as proof of the date of dispatch.

Where withdrawal is exercised by email, the withdrawal shall only be taken into account once the Customer has received an email confirming that the order cancellation request has been registered.

Where the Customer has taken delivery of the product or products during the withdrawal period, the Customer must return them to daniel@sofrout.com under the conditions described in Article 8 of these General Terms and Conditions in order for the cancellation request to be definitively approved and for the product or products to be refunded. Shipping costs shall be borne by the Customer.

11 – INTELLECTUAL PROPERTY

11.1

Unless otherwise stated, all texts, comments, works, illustrations and images reproduced on Sofrout.com are protected throughout the world by copyright and intellectual property rights.

In accordance with the provisions of the French Intellectual Property Code, only use for private purposes is authorised, subject to any different or more restrictive provisions contained in the Intellectual Property Code.

Any total or partial reproduction of the Sofrout.com website is strictly prohibited.

11.2

Certain products, including software in particular, are subject to personal and specific rights of use governing copying, public distribution and rental.

You must comply with the general terms and conditions of sale applicable to such products. Sofrout.com shall not be held liable for any use made of the products in this context.

12 – LIABILITY

The products offered comply with the Israeli legislation in force and with the standards applicable in Israel.

Sofrout.com shall not be held liable in the event of non-compliance with the legislation of the country to which the product is delivered, for example where a product is prohibited.

It is your responsibility to check with the local authorities whether the products or services you intend to order may be imported or used in your country.

The photographs and graphics reproducing and illustrating the products presented are provided for illustrative purposes only.

Sofrout.com shall not be held liable for failure to perform the contract in the event of force majeure, disruption, or a total or partial strike, particularly affecting postal services, transport and/or communication services, flooding or fire.

The total or partial inability to use the products, particularly due to equipment incompatibility, shall not give rise to any compensation, refund or liability on the part of Sofrout.com.

Our products offer performance compatible with professional use, even though Sofrout.com does not primarily sell to professionals.

Consequently, Sofrout.com shall not be held liable for any loss or damage of any kind resulting from a professional activity.

13 – APPLICABLE LAW AND DISPUTES

This contract is governed by Israeli law.

The language of this contract is French. The French version of these General Terms and Conditions of Sale shall be the only legally binding version.

In the event of a dispute, the Parties agree to contact one another in an attempt to reach an amicable solution.

Should no amicable solution be reached, the Israeli courts shall have jurisdiction to hear the dispute.

The Sofrout.com website is hosted and administered from Israel, and these General Terms and Conditions are governed by Israeli law.

Should any provision of these General Terms and Conditions be considered null and void pursuant to a current or future legal or regulatory provision, or pursuant to a final court decision issued by a competent court or authority, that provision shall be deemed unwritten.

All other provisions of these General Terms and Conditions shall remain binding between the Parties.

These provisions do not deprive customers residing outside Israel of the rules provided for under any international conventions applicable to them.

14 – PERSONAL INFORMATION

Collection of your data

Sofrout.com collects personal data concerning you through the Website in order to provide you with an efficient and personalised service capable of meeting your needs and helping you use our services more easily and quickly.

Use of your data

In addition to the information contained in your personal file, we use information obtained from your current and previous activities on our Website to resolve disputes, deal with problems and enforce our General Terms and Conditions of Subscription.

Where necessary, we may compare information relating to several users in order to identify and resolve problems, particularly by using your data to detect users operating under several identities or usernames.
